Terms of Service

Welcome to Everpage (hereinafter the "Service" or the Services" and defined as the websites at ever.page, everpage.com and other domain extensions related to "Everpage", the website at getdeep.app, and the Deep app published by Everpage at the Apple App Store and the Google Play Store). You agree to be bound by the following Terms of Service Agreement (hereinafter "Agreement"). Please read this Agreement carefully before using the Service.

Acceptance of Terms of Use Agreement


1. By accessing or using the Service, you agree to be bound by this Agreement, and you represent and warrant that you have the legal authority to enter into this Agreement. If you do not agree to these terms, please do not use the Service.


Description of Service


2. The Service is an online platform that uses AI to help users write short, personal biographies that will be public and shared. The Service provides users with tools and resources to create their own personal biographies, including the ability to customize content, format, and style. The Service also allows users to share their personal biographies and displays their biographies to other users.


User Content


3. The Service allows users to upload, create, and publish personal biographies. Users are solely responsible for the accuracy, completeness, and legality of their personal biographies. By uploading, creating, and publishing personal biographies, users represent and warrant that they have the legal right to do so and that their personal biographies do not infringe the rights of any third party.


Privacy Policy


4. We take the privacy of our users very seriously. Our Privacy Policy outlines how we collect, use, and protect the information that you provide to us when you use the Service. By using the Service, you agree to our Privacy Policy.


Ownership and Intellectual Property


5. All content and materials on the Service not created by users using the AI tools provided, including but not limited to text, graphics, logos, images, software, and code, are the property of the Service or its licensors and are protected by copyright, trademark, and other intellectual property laws. Users are not permitted to use any content or materials on the Service without the prior written consent of the Service.


Ownership of User-Generated Content


6. Users retain ownership of the personal biographies they create using the Service. However, by uploading, creating, and publishing personal biographies, users grant the Service a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, reproduce, modify, and distribute the personal biographies for the purpose of operating, promoting, and improving the Service. Users represent and warrant that they have all necessary rights to grant the license above, and that their personal biographies do not infringe the intellectual property rights or other rights of any third party. The Service reserves the right to remove any personal biographies that it deems to be in violation of this Agreement or applicable law.


Content Removal


7. Everpage reserves the right to remove any content created by users from the Service for any reason, including but not limited to:

  • Content that violates these Terms or any applicable laws or regulations
  • Content that infringes on the intellectual property rights of others
  • Content that is harmful, threatening, or otherwise objectionable
  • Content that is spam or advertising
  • Content that contains personal information of others without their consent
  • Content that is created for the purpose of domain-squatting
  • Content that exhibits inauthentic or inappropriate social behavior

If Everpage removes any user-generated content from the Service, we will make reasonable efforts to notify the user who created the content and provide a reason for the removal. 

Prohibited Conduct


8. Users are prohibited from using the Service for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Service. Users are also prohibited from engaging in any activity that interferes with or disrupts the Service, including but not limited to hacking, phishing, or spamming.


Indemnification


9. Users agree to indemnify, defend, and hold harmless the Service and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to the user's use of the Service or breach of this Agreement.


Disclaimer of Warranties


10. The Service is provided "as is" and without warranties of any kind, either express or implied. The Service does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.


Limitation of Liability


11. In no event shall the Service or its officers, directors, employees, agents, or affiliates be liable to any user or third party for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Service, even if the Service has been advised of the possibility of such damages.


Termination


12. The Service may terminate or suspend a user's account and access to the Service at any time, with or without notice, for any reason or no reason.


Governing Law and Venue


13. This Agreement shall be governed by and construed in accordance with the laws of New York State, where the Service is headquartered, without giving effect to any principles of conflicts of law. Any legal action arising out of or related to this Agreement or the Service shall be filed exclusively in the state or federal courts located in the state where the Service is headquartered, and users consent to personal jurisdiction in such courts.


Changes to the Agreement


14. The Service reserves the right to modify this Agreement at any time, with or without notice. Users are responsible for regularly reviewing this Agreement for any updates or changes. Continued use of the Service after any modifications to this Agreement shall constitute acceptance of such modifications.

Entire Agreement


15. This Agreement constitutes the entire agreement between the user and the Service and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between the user and the Service.
